Welcome to the BiCupid App. This End User Service Agreement explains your legal rights, responsibilities, and safety guidelines when using our website, mobile application, and matching platform.

By registering an account, downloading the BiCupid App, or accessing our services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not complete the registration process or use the platform.

1. Eligibility and Age Requirements

To maintain a safe, mature, and respectful environment, the BiCupid App enforces strict eligibility criteria:

  • You must be at least 20 years old to register and use our platform.
  • You must have reached the age of majority and legal consent in your jurisdiction.
  • You must not be subject to any registration requirements under local, state, or federal sex offender registries.

2. Account Registration and Waiting List Process

To create your account, you must provide a valid email address, a unique username, and a secure password. You are solely responsible for keeping your credentials confidential and for all activities that occur under your account.

Please Note: To ensure the quality and security of our community, all applications are initially placed on a waiting list. After internal review, we reserve the right to approve or decline applications at our sole discretion. You are only considered a formal Member once your profile has been approved.

Members are restricted to maintaining a single account within the BiCupid App ecosystem; duplicate profiles are strictly prohibited.

3. Profile Visibility and Affiliate Networks

To increase your opportunities for meaningful connections, your profile will be visible to members who register directly via the BiCupid App as well as users from explicitly associated Affiliate Sites.

We provide integrated privacy settings that allow you to block specific users, hide selected photos, and create private albums. Your profile and sensitive content will not be indexed or visible on unmanaged Third-Party Sites that simply link to our platform.

4. Content Ownership and Smart Safety Moderation

You retain full ownership of the text, photos, and materials ("Content") you upload. However, by sharing content, you grant the Company a worldwide, perpetual, non-exclusive, royalty-free license to host, display, and distribute your content across our application environment.

To protect community safety and enforce our anti-fraud policies, we use automated systems and machine learning combined with human moderation. These systems automatically review and assess communication patterns, flags, and text for keywords associated with financial exploitation, commercial solicitation, or violations of this Agreement.

5. Acceptable Use and Code of Conduct

The BiCupid App is strictly for lawful, personal, non-commercial, and non-transactional dating. Any use by commercial organizations, media entities, or business competitors is prohibited.

Strictly Prohibited Activities:

  • Requesting, offering, negotiating, or facilitating Pay-Per-Meet (PPM), escort services, prostitution, hookups, or any transactional/compensated relationships.
  • Using automated scrapers, bots, spiders, crawlers, or scripts to access or extract platform data.
  • Capturing screenshots, screen recordings, or copying other members' profile content without express written consent.
  • Including visible phone numbers, street addresses, last names, URLs, or external contact links inside your public profile details.
  • Harassing, threatening, or engaging in abusive behavior towards other members or support staff.

6. Content Enforcement Authorization

To aggressively combat identity theft and profile scraping, each member grants the Company the legal authority to act on their behalf as an agent. If your photos or personal data are scraped, stolen, or illegally hosted on external third-party platforms, the Company may choose, at its sole discretion, to pursue legal recourse against those unauthorized users.

7. No Background Screening Disclaimer

You acknowledge that the Company does not conduct automated criminal background checks or general identity screenings on its members upon registration. You assume all inherent risks associated with online and offline interactions. Always practice caution and prioritize your personal safety when connecting with new individuals.

Any optional "Verified" badges provided on user profiles are handled by independent third-party validation networks. We do not explicitly warrant or guarantee the absolute accuracy or long-term safety profile of any verified status.

8. Chairman Concierge Services

If you opt into our specialized Chairman tier membership, all features are provided strictly as concierge-style advisory, guidance, and coordination support. These advisory features do not constitute formal security, legal, or professional investigative services, nor do they include unpermitted database access or communication wiretapping.

9. Warranties and Limitation of Liability

Our platform is provided entirely on an "As Is" and "As Available" basis. To the maximum extent permitted by applicable law, the Company's total liability for any claim arising out of this Agreement shall not exceed the greater of US$30.00 or the exact amounts paid by you to the platform in the twelve (12) months preceding the dispute. US residents explicitly waive their rights under California Civil Code §1542 regarding unknown or hidden historical claims.

10. Subscriptions, Auto-Renewals, and Deletion

Paid subscriptions automatically renew for the same duration as your initial term (e.g., monthly, quarterly, or bi-annually) to ensure uninterrupted service. You can disable auto-renewal or modify your plan at any time through your app account settings.

You may close your account and request profile deletion at any time. Following account termination, we explicitly reserve the right to retain core account records, transactional logs, and content metrics for legal compliance, active analytics, and fraud tracking.

11. Governing Law and JAMS Arbitration

These Terms of Service are governed by the substantive laws of the State of Delaware, without regard to its conflict of law principles.

Any dispute, claim, or controversy arising from your use of the platform shall be settled exclusively via binding arbitration in San Francisco, California before JAMS, pursuant to JAMS Comprehensive Arbitration Rules.

  • Class Action Waiver: You and the Company agree that all arbitration proceedings must be handled strictly on an individual basis, and not as a plaintiff or class member in any class or representative action.
  • Time Limit: Any legal claim or arbitration request must be initiated within one (1) year after the dispute first arose, or it is permanently barred.

12. Digital Millennium Copyright Act (DMCA) Notice

If you believe your copyrighted materials have been copied or shared inappropriately on the platform, please forward a formal DMCA Notice to our Designated Agent:
